Terms of Service

These Terms of Service govern your use of the IronSight Digital website. Separate proposals, service agreements, order forms, statements of work, invoices, or platform terms may apply when you purchase or receive services from IronSight Digital.

Effective date: August 1, 2026

Last updated: August 1, 2026

Acceptance of Terms

By accessing or using this website, you agree to these website Terms of Service. If you do not agree, do not use the website. Viewing the website, submitting a form, or using chat does not by itself create a paid-client relationship.

Website Purpose

The website provides general business information, service descriptions, pricing guidance, project examples, educational content, contact and audit-request tools, and AI-assisted website chat.

Website content is informational and may not reflect every service detail, limitation, availability condition, or client-specific requirement.

Inquiries and Estimates

Contact forms and Digital Presence Audit requests do not create a client relationship.

Website pricing may be described as starting prices or general package prices.

Custom work may require discovery and a separate quote.

Submitting information does not guarantee acceptance of a project or service availability.

IronSight Digital may decline work outside its capabilities, availability, values, or service scope.

Paid Services and Separate Agreements

Paid services are governed by the applicable proposal, service agreement, order form, statement of work, invoice, or other written terms accepted by the client.

If a separate written agreement conflicts with these general website Terms, the separate agreement controls for that engagement. Refund, cancellation, ownership, licensing, and transfer terms remain engagement-specific unless separately approved in writing.

Pricing and Availability

Prices and service descriptions may change.

Starting prices depend on scope and project requirements.

Monthly services may involve setup fees, usage charges, initial terms, or separate scope terms where disclosed.

Website information does not guarantee that a service is currently available.

Final pricing, scope, and applicable terms are confirmed in writing.

Client Responsibilities

For paid engagements, clients may be responsible for the following as applicable to the work:

Providing accurate information and timely feedback or approvals.

Providing content and media they have permission to use.

Maintaining access to required platforms and protecting credentials and account access.

Reviewing deliverables and notifying IronSight Digital of material concerns.

Complying with applicable laws and obtaining required permissions or consents for customer communication.

AI and Automation Limitations

AI and automated systems may generate incomplete, inaccurate, delayed, or inappropriate responses. They can depend on third-party platforms, integrations, connectivity, available data, and configuration.

AI and automation require monitoring and appropriate human oversight.

They should not be relied on for emergency, legal, medical, financial, or safety-critical decisions.

No system can guarantee that every lead, call, message, or workflow will be captured or processed correctly.

Clients remain responsible for reviewing important automated communication and maintaining appropriate backup procedures.

Intellectual Property

IronSight Digital website copy, graphics, branding, layouts, and original materials are protected by applicable intellectual-property laws. Visitors may not reproduce, republish, sell, scrape, or distribute those materials without permission.

Third-party trademarks and materials remain owned by their respective owners. Client ownership and licensing rights for paid deliverables are governed by the applicable client agreement; these website Terms do not create blanket ownership or website-transfer rules for paid work.

Acceptable Use

You may not misuse the website, contact forms, or chat system.

Use the website for unlawful activity, fraud, impersonation, harassment, or abusive communication.

Attempt unauthorized access, introduce malware, or interfere with website security or operation.

Use automated scraping or other activity that unreasonably burdens the website.

Submit content that infringes another person’s rights.

Misuse contact or chat tools for spam, deception, or disruption.

Third-Party Services

The website and IronSight Digital services may rely on third-party tools. Third-party terms and policies may also apply.

IronSight Digital does not control every third-party platform and cannot guarantee continuous availability, compatibility, data retention, pricing, feature continuity, security, or policy stability for those services.

No Guarantees

IronSight Digital does not guarantee search rankings, leads, revenue, sales, conversion rates, review volume, review ratings, platform approvals, account reinstatement, social-media reach, AI accuracy, automation uptime, or any specific business outcome.

Results depend on market conditions, competition, client participation, third-party platforms, customer behavior, technical conditions, and other factors outside IronSight Digital’s control.

Disclaimers

The website and general information are provided on an as-available basis to the extent permitted by law. Website content is not a substitute for legal, financial, medical, or other professional advice.

Nothing in these Terms excludes responsibilities that cannot legally be excluded under applicable law.

Limitation of Liability

To the extent permitted by law, IronSight Digital is not liable for indirect, incidental, special, consequential, or punitive damages arising solely from use of the public website.

Liability related to paid services may be addressed separately in the applicable client agreement. These website Terms do not create a separate dollar cap for paid-service liability.

Indemnification

To the extent permitted by law, you agree to be responsible for claims, losses, or reasonable costs resulting from your misuse of the website, unlawful content you submit, or your violation of these Terms. This clause does not create a blanket indemnity for unrelated business disputes.

Termination or Restricted Access

IronSight Digital may restrict access to the website, chat, or forms when reasonably necessary to address abuse, fraud, security threats, illegal activity, or repeated misuse.

This section governs access to the public website and does not determine termination rights for paid client services, which remain subject to the applicable client agreement.

Governing Law

These website Terms are governed by the laws of the State of Alabama, without regard to conflict-of-law principles, except where applicable law requires otherwise.

Changes to These Terms

These Terms may be updated periodically. The Last Updated date will reflect changes. Continued website use after an update constitutes acceptance only to the extent permitted by law.
